EscaladE Sarl acts exclusively as a technical intermediary connecting the two parties.

1. Access to the website

Access to the website is free of charge for any user with an Internet connection.
The publisher cannot be held liable for any interruption due to maintenance, updates or technical issues.

1. How the service operates

Users may:

• view published listings,

• contact an owner via the form or information provided,

• request additional information.

The publisher:

• does not monitor or manage contracts,

• does not participate in payments,

• does not guarantee the accuracy of information provided by owners,

• cannot be held liable in the event of a dispute between the parties.

1. Publication of listings

Owners submitting a listing undertake to provide:

• accurate and up-to-date information,

• photographs that faithfully represent the villa,

• a description that accurately reflects the property.

EscaladE Sarl reserves the right to modify, reject or remove any content that is clearly inaccurate, misleading or unlawful.

1. Commissions

The website operates on a transparent business model:

• 5% commission on rentals (between owners and tenants)

• 1% commission on sales where the introduction results in a completed transaction

These commissions are payable directly by the owner, never by the tenant or buyer.

No payment is made through the website.

1. Owner’s obligations when submitting a listing

7.1 Receipt of enquiries

The owner expressly acknowledges that:

• they do not receive any direct enquiries originating from the listing published on Villas-Luxe-Maurice.com

• all messages and enquiries from potential tenants or buyers must be routed through EscaladE Sarl, which forwards them to the owner

• evidence of the introduction shall consist of:

  • messages forwarded by EscaladE Sarl

  • exchanges generated through the website forms

  • technical logs and internal records of the platform

This system ensures full traceability of prospects and introductions.

7.2 Reporting the outcome of enquiries

The owner undertakes to inform EscaladE Sarl:

• of the progress of each enquiry forwarded

• whether or not a booking or sale is concluded

• of the reasons for any enquiry not resulting in a transaction

This reporting obligation is mandatory in order to allow commissions to be invoiced correctly.

7.3 Mandatory commissions

The owner agrees that all transactions resulting from an enquiry forwarded by EscaladE Sarl shall give rise to:

• a 5% commission on any confirmed rental

• a 1% commission on any completed sale

The commission remains payable even if:

• the transaction is completed at a later date

• discussions continue outside the platform

• the prospect returns several weeks or months later

7.4 Right to use supplied content

By providing photographs, descriptions, the villa name or any other content, the owner grants EscaladE Sarl:

• a free, non-exclusive, unlimited and transferable right of use

• for publication of the listing

• for any marketing activities required to promote the villa and the website

• including: social media, advertising, emailing, visual editing, SEO, etc.

1. Liability

EscaladE Sarl cannot be held liable for:

• information provided by owners,

• any contractual, financial or legal dispute between users,

• any direct or indirect damage related to use of the website.

The user acknowledges that they use the website entirely at their own responsibility.

1. Data protection

The collection and processing of personal data are carried out in accordance with the website’s Privacy Policy.

1. Intellectual property

All content on the website (texts, photographs, videos, logos) is protected.
Any unauthorised reproduction or use is prohibited.
By submitting a listing on the website, the owner authorises us to use their photographs, texts and villa name for marketing purposes.

1. Amendment of the Terms of Use

The publisher may amend these Terms of Use at any time.
Users are invited to review them regularly.

1. Governing law

These Terms of Use are governed by French law.
In the event of a dispute, the competent courts shall be those within the jurisdiction of the Grasse Court.
